1. Introduction
Welcome to MutualSupportCenter ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at mutualsupportcenter.sbs (the "Service") operated by MutualSupportCenter.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
MutualSupportCenter offers elite yacht charter services, which include, but aren't limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Availability of services may vary and are contingent on weather conditions. Our right to alter or cease services is reserved at any time.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you are required to:
- Be at least 18 years old
- Submit truthful and complete details
- Remit the necessary deposit as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
A booking is only considered confirmed subsequent to payment and our written acknowledgement. We have the authority to decline service to any person at our sole discretion.
3.3 Availability
Charters are reliant on the availability of the vessel and favorable weather conditions. We will endeavor to accommodate your preferred scheduling.
4. Payment Terms
4.1 Pricing
Our quoted prices are in € and incorporate relevant taxes, unless stated otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter fee is required at the time of booking
- Balance: To be paid 48 hours prior to charter departure
- Extra charges (if applicable): Payable after the completion of the charter
4.3 Payment Methods
We accept various forms of payment, including major credit cards, bank transfers, and certified cheques. All payments are processed using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund, subtracting any processing fees
- 24-72 hours before departure: 50% refund
- Less than 24 hours before departure: No refund granted
5.2 Weather Cancellations
Should weather conditions be decided unsafe by our captain, we will propose to:
- Reschedule the charter to an alternative date without extra costs
- Issue a full refund if rescheduling is unfeasible
5.3 Mechanical Issues
In the case of mechanical issues with the designated vessel, we will try to offer an appropriate replacement. If a replacement isn't available, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Adhere to instructions from the crew
- Utilize safety gear as directed
- Disclose any medical conditions that could affect their safety
- Stay within the designated areas on board
6.2 Prohibited Items
The items below are not allowed on the vessel:
- Glass containers
- Illegal substances
- Weapons or firearms
- Excess amounts of non-alcoholic drinks beyond reasonable consumption
- Pets (unless agreed upon beforehand)
6.3 Conduct
Passengers are expected to behave respectfully. Should passenger conduct pose a safety threat or disrupt other guests' experience, we reserve the right to terminate the charter early with no refund.
7. Liability and Insurance
7.1 Our Liability
We are liable only up to the cost of your charter. We are not responsible for:
- Injuries stemming from passenger negligence
- Theft or damage to personal belongings
- Indirect, consequential, or punitive damages
- Delays due to weather or other circumstances beyond our control
7.2 Insurance Coverage
We carry comprehensive marine insurance for our boats and operations. Customers should ensure their own travel and personal insurance.
7.3 Assumption of Risk
By using our charter services, you accept that sailing activities come with inherent dangers and you assume full responsibility for your own safety and welfare.
8. Modifications and Itinerary Changes
We have the right to alter itineraries, routes, or schedules due to weather conditions, safety reasons, or operational demands. We will make all reasonable attempts to provide a similar alternative experience.
9. Force Majeure
We are not held responsible for delays, cancellations, or changes brought about by unforeseen forces, including but not restricted to:
- Extreme weather events
- Natural calamities
- Governmental laws
- Port shutdowns
- Equipment failures
10. Privacy and Data Protection
Your private data is managed in line with our Privacy Policy. Utilizing our services indicates your consent to the gathering and usage of your information as laid out in our Privacy Policy.
11. Intellectual Property
The content on our website, such as text, graphics, logos, and imagery, is safeguarded by copyright and trademark legislations. Unauthorized reproduction, distribution, or the creation of derivative works is prohibited without our explicit written consent.
12. Governing Law
These Terms are subject to the laws of Spain. Disputes will be settled in the courts of Barcelona, Spain.
13. Changes to Terms
We reserve the right to amend these Terms at our discretion. Updates will be publicized on our website along with the revised date. Your continued use of our services signifies acceptance of the amended terms.
